DuPont workers say pension changes are against ERISA

Law360 (Sept. 7, 2021, 6:38 p.m. EDT) – Current and former DuPont employees have filed a class action lawsuit in Pennsylvania federal court alleging the company withdrew their early retirement benefits following a spin-off, in violation of federal benefits Law.

Two current participants in DuPont’s retirement plan – longtime employee Robert Cockerill and former employee Christopher Newton – argued on behalf of potentially thousands of employees in Friday’s complaint that DuPont was in violation of the Employee Income Security Act when it did identified certain employees as “terminated” by DuPont following a spin-off and not entitled to early retirement.
